Terms and conditions

These terms apply to everything sold through this website: our own software, used hardware and the payment of invoices in the customer area. Terms of a customer that differ apply only if they have been agreed in writing.

1. Conclusion of contract

The contract comes into being when the order has been submitted and the payment has been confirmed by the payment provider. Before that no obligation arises — an abandoned order lapses.

2. Prices and invoice

All prices are in Swiss francs. Whether and how much value added tax applies is shown on the invoice; where there is no tax liability, that is stated there expressly. The invoice is issued immediately after payment and is thereby settled.

3. Software: delivery and use

Digital products are delivered immediately after payment — by download link and, where the product provides for it, with a licence key. The link is time-limited; the entitlement is not. Licence and current version are permanently available in the customer area, and an expired link can be renewed there by yourself.

What is acquired is a right of use, not the software itself. The number of permitted installations follows from the licence key; an installation can be moved to another system at any time. Passing on, renting out and sub-licensing require written consent. Copyright remains with the provider.

Software that requires a licence checks its validity at regular intervals. If the service is temporarily unreachable, it keeps running unchanged for the grace period stated on the product.

4. Term and renewal

If a plan with a term is bought, it renews for the same period unless it is cancelled before that period ends. The invoice for the following period is issued in advance; only payment in full renews the licence. With a perpetual licence this does not apply.

While the licence runs there is an entitlement to all updates. When it ends, either the last version obtained remains usable or use ends — what applies is the rule stated on the product.

5. Used hardware

Sold are used devices from our own stock. Condition, known defects and scope of delivery are described in the offer; that description is part of the contract. Storage media are wiped before handover.

The goods are sold as they stand: towards companies the warranty for defects is excluded (Art. 199 CO). Towards private individuals, instead of the exclusion, a shortened warranty period of twelve months from handover applies. In both cases, fraudulently concealed defects and expressly warranted qualities remain unaffected.

Obvious defects must be notified within seven days of receipt. Shipping is within Switzerland; risk passes to the buyer on handover. Collection is possible by arrangement.

6. Returns and refunds

The returns and refunds policy applies. It is part of these terms.

7. Services

IT services are agreed separately and billed by time and material or at the agreed fixed price. Paying an invoice in the customer area changes nothing about the underlying agreement.

8. Liability

Liability is limited to intent and gross negligence and, in amount, to the fee paid for the service concerned. Liability for data loss exists only where a backup corresponding to the state of the art was in place. Software is never free of faults; reported faults are fixed within a reasonable time.

9. Applicable law

Swiss law applies, excluding the Convention on Contracts for the International Sale of Goods. Place of jurisdiction is the seat of the provider, unless another one is mandatory.

This is a translation. In case of doubt the German version applies.
